In a recent development, the Special Parliamentary Committee has nominated Justice Yahya Afridi for the next Chief Justice of Pakistan. It should be noted that the panel consisted of Justice Munir, Justice Mansoor Ali Shah and Justice Yahya Afridi. Ministry of Law and Justice has released the official notification regarding his appointment and he will be taking oath on 26th October as the next Chief Justice of Pakistan.
Justice Yahya Afridi stands third in the seniority list and he will be replacing the current CJP Qazi Faiz Esa who is set to retire on Oct 25th, 2024. The meeting of the Special Parliamentary Committee was attended by Pakistan Muslim League-Nawaz’s (PML-N) Senator Azam Nazir Tarar, Khawaja Asif, Ahsan Iqbal, and Shaista Pervaiz; Pakistan People’s Party’s (PPP) Farooq H Naek, Raja Pervaiz Ashraf, and Syed Naveed Qamar; Rana Ansar of Muttahida Qaumi Movement-Pakistan (MQM-P) and Senator Kamran Murtaza of Jamiat Ulema-e-Islam-Fazl (JUI-F).
After making Supreme Court subservient to Executive/Parliament, they have now stopped Justice Mansoor Ali Shah from becoming CJP, an upright, unbiased and balanced judge. More importantly he never had a self-righteous or Messiah attitude like judges in the past.

On the other hand, Barrister Gohar, Barrister Ali Zafar and Sunni Ittehad Council’s Chief, Sahibzada Hamid Raza remained absent from the meeting as they boycotted it. It is pertinent to mention here that the committee has even formed a four-member sub-committee in order to convince PTI leaders to attend the meeting. The sub-committee consists of the members Ahsan Iqbal, Rana Ansar, Raja Pervez Ashraf and Kamran Murtaza to bring the PTI leaders to the same front.

Despite the efforts, Barrister Gohar stated, “We have made our decision. We will not be part of this committee’s meetings.” It should be noted that the formation of this parliamentary committee is a result of the constitutional amendment made to Article 175A of the constitution which changes the methodology of appointing Supreme Court judges.
However, it is pertinent to mention here that Justice Yahya Afridi will be the first judge to be the Chief Justice of Pakistan from Federally Administered Tribal Areas (FATA). It should be noted that he took oath as the Chief Justice of Peshawar High Court on 30th December 2016. However, on 28th June 2018, he was promoted as the Judge of the Supreme Court of Pakistan.
On that noted, the Special Parliamentary Committee has forwarded the name of Justice Yahya Afridi to the Prime Minister who will then send it to President of Pakistan for final approval.
