In a recent news, the President of Pakistan, Asif Ali Zardari, has signed the 26th Constitutional Amendment Bill into law on the advice of Prime Minister, Shehbaz Sharif. With this approval, it has been notified that the 26th constitutional amendment has been made part of the 1973 constitution of Pakistan. It should be noted that the amendment has been passed from both houses of the Parliament, i.e., National Assembly and Senate, with two-third majority.
However, it is pertinent to mention here that under this amendment, the tenure for the Chief Justice of Pakistan has been set at three years. The legislation deals with taking away the Suo-motto powers of the Supreme Court. Amendments have been made to the Clause 3 of the Article 175A in which the top judge of the Supreme Court will now be “appointed on the recommendation of the Special Parliamentary Committee from amongst the three most senior SC judges.”
According to this constitutional amendment, the Parliamentary Committee will send the names of the nominees to the Prime Minister and the Prime Minister will then forward the names to the President of Pakistan for appointment.
On the other hand, the Jamat-e-Islami Chief, Hafiz Naeem ur Rehman, has quoted the 26th Constitutional Amendment as a “dark chapter” of Pakistan’s judicial and political landscape. He stated, “Regretfully to say, the grandson of Zulfikar Ali Bhutto yesterday damaged the spirit of the constitution. More than half of the parliament members didn’t win the election.”
